It is understood that GARRETT MUSEAU PHOTOGRAPHY is the exclusive official Photography Company retained to perform the photography and/or videography services requested.

GARRETT MUSEAU PHOTOGRAPHY may substitute another Photographer to take the photographs in the case of illness or of scheduling conflicts. In the event of such substitution, GARRETT MUSEAU PHOTOGRAPHY warrants that the Photographer taking the photographs and/ or video shall be a competent professional. At weddings or other events GARRETT MUSEAU PHOTOGRAPHY can use the images in any way on social media for marketing purposes.

When the final products are ready client has up to 90 days to request any changes or ask for editing. After 3 months GARRETT MUSEAU PHOTOGRAPHY is not responsible for original raw footage (photo/video). All edited photos and videos will be available on a digital gallery for up to 1 year after delivery.

GARRETT MUSEAU PHOTOGRAPHY has the nonexclusive, perpetual, irrevocable, and worldwide rights to use, to crop, to modify if necessary, to reproduce, and to distribute the photograph, hereinafter referred to as the photograph, as described, in print and in all other formats, methods, and technologies of distribution of any kind, now known or later developed.

 

Negatives, digital files, and previews remain the exclusive property of GARRETT MUSEAU PHOTOGRAPHY. 

 

Upon signature and payment of deposit amount, GARRETT MUSEAU PHOTOGRAPHY shall reserve the time and date agreed upon.  All retainers/deposits are 30% of the original fee of service. 

 

Client agrees to notify GARRETT MUSEAU PHOTOGRAPHY, as soon as possible, of any changes to date, time and location of services. In order to receive full refund, cancellation must be made 30 days prior to the event.. After that time all refunds are subject to the disgression of GARRETT MUSEAU PHOTOGRAPHY.

 

Client is aware that color dyes in any printed Photography may fade or discolor over time due to the inherent qualities of the dyes, and Client releases the Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. 

 

Client understands that the final number of delivered images is dependent on Photographer’s discretion and that any unsuitable images (blurry, doubles, under/over exposed) will be permanently discarded. 

 

The charges in the Contract are based on GARRETT MUSEAU PHOTOGRAPHY’s  Package and Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed. Full payment of the services shall be submitted 30 days prior to the event. If full payment is not received prior to the event, photography services may not be performed. 

 

NOTICE OF COPYRIGHT: It is ILLEGAL to modify, copy, or reproduce these photographs without GARRETT MUSEAU PHOTOGRAPHY’s  permission and violators of this, Laws of United State of America, shall be subjected to its civil and criminal penalties. 

 

The Client shall use purchased photos and videos for personal,  non-commercial use only. The Client may display the photos/ videos on their personal computers and may print the photos for personal use. The Client may also display the photos / video on their personal websites and social media so long as the media is unaltered and includes credit to GARRETT MUSEAU PHOTOGRAPHY.

CANNCELLATION POLICY

 

In case of cancellation or rescheduling of the event: If GARRETT MUSEAU PHOTOGRAPHY can not accommodate your new date or if the event has to be cancelled (see item 7), the client will be charged for any services rendered in conjunction with the Photography Package thus far. For example, if the Engagement Session has already taken place; the retail value of the Engagement Session will be deducted from the Initial Deposit and all other funds will be returned to the client. 

 

If GARRETT MUSEAU PHOTOGRAPHY cannot perform this contract due to fire or other casualty, strike, or any other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return Session Fees and retainers/deposits to the client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that GARRETT MUSEAU PHOTOGRAPHY fails to perform for any other reason, GARRETT MUSEAU PHOTOGRAPHY shall not be liable for any amount in excess of the retail value of the Client’s order.
